By accessing or using ShiftCheck ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including workers, venue owners, and visitors.
ShiftCheck is operated by ShiftCheck ("we," "us," or "our"), based in Austin, Texas.
ShiftCheck is an anonymous review platform that allows current and former hospitality industry workers — including bartenders, servers, bussers, hosts, barbacks, and food runners — to submit anonymous ratings and reviews of bars, restaurants, and other hospitality venues where they have worked. ShiftCheck also provides compensation data, venue profiles, and job postings.
You must be at least 18 years old to use ShiftCheck. By using the Platform, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

When you submit a review, rating, or other content to ShiftCheck ("User Content"), you represent and warrant that:
By submitting User Content, you grant ShiftCheck a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content on the Platform.
While reviews are displayed anonymously, you acknowledge that your account is associated with your submitted reviews for moderation and spam prevention purposes. We will not publicly associate your identity with your reviews.

ShiftCheck operates as an interactive computer service under Section 230 of the Communications Decency Act (47 U.S.C. § 230) and is not the publisher or speaker of user-generated content.
All reviews, ratings, written content, and compensation data submitted on ShiftCheck represent the personal opinions and experiences of individual users and do not represent the views, opinions, or positions of ShiftCheck or its operators.
ShiftCheck does not verify the accuracy, completeness, or truthfulness of any user-submitted content. Reviews reflect individual opinions and personal experiences, not verified statements of fact. ShiftCheck is not responsible for any claims, damages, losses, or harm resulting from reliance on user-generated content.
ShiftCheck reserves the right, but not the obligation, to review, remove, or modify any User Content at any time and for any reason, including but not limited to content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.
Venues may dispute reviews they believe violate these Terms through our dispute process. ShiftCheck will review disputes in good faith and make removal decisions at our sole discretion. Submission of a dispute does not guarantee removal of a review.
Hourly pay and nightly tip data submitted by users represents self-reported information from individual workers. ShiftCheck does not verify the accuracy of compensation data. This information is provided for general informational purposes only and should not be relied upon as a guarantee of earnings at any venue.
Venue owners who claim their venue profile on ShiftCheck represent that they are authorized to manage the venue's online presence. Venue owners may not:
ShiftCheck and its original content, features, and functionality are owned by ShiftCheck and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.
The Platform is provided "as is" and "as available" without any warranties of any kind, express or implied. ShiftCheck does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, ShiftCheck shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Platform.
In no event shall ShiftCheck's total liability to you exceed the amount you have paid to ShiftCheck in the twelve months preceding the claim, or $100, whichever is greater.
Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. The arbitration shall take place in Austin, Texas. You waive any right to a jury trial or to participate in a class action lawsuit.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the new Terms.
